Law Increases Spouse's Share of Intestate Estate

A Maryland law went into effect on October 1, 2017, that increases a surviving spouse's share of an intestate estate.   The law provides that the statutory share for a surviving spouse of a decedent who died without minor children, and who died intestate (i.e., without having a Will in place at the time of death) was increased from $15,000 plus one-half of the remainder of the estate to $40,000 plus one-half of the remainder of the estate.

Allowable Funeral Expenses Increases to $15,000

For many estates, funeral or memorial services are the largest expense; however, there is a Maryland law which limits the amount of allowable funeral expenses.   The law was recently amended to increase the limit on allowable funeral expenses.  Previously the limit was $10,000. For estates opened on or after October 1, 2015, the maximum allowable funeral expenses have increased to $15,000.  Funeral expenses are defined under the law as the costs of a funeral, a burial, a cremation, a disposition of the decedent's remains, a memorial, a memorial service, food and beverages related to bringing together the decedent's family and friends for a wake or prefuneral or postfuneral gathering or meal, and any other reasonable expenses authorized by the decedent's will.  The limit on funeral expenses applies unless the Orphans’ Court approves a higher amount or the decedent’s Will states funeral expenses may be paid in any amount without an Order of Court.   Also, an Order of Court is not required if the Estate is in modified administration, the Estate is solvent, and the expense is listed by the Personal Representative on his or her Final Report.  Lastly, in any case the Orphans’ Court may approve or deny funeral expenses in any amount depending on the circumstances and condition of the decedent.
