Civil Litigation

Our Philosophy:  There are few cases than cannot and should not be settled.  However, when all efforts to negotiate a satisfactory settlement have been exhausted, resort to the Courts may be necessary.  In that event, it is critical that you be represented by experienced civil litigation counsel.  Not all attorneys venture into the courtroom, and trial lawyers comprise a fraction of practicing lawyers.

In the event you have a claim against another party, whether it arises out of a contractual or business relationship or from an intentional or negligent act which causes injury to you, there are various methods short of litigation that can be employed to resolve the dispute.  If direct settlement negotiations are unsuccessful, prospective litigants can employ a mediator or settlement facilitator to assist them in reaching an accord.  Mediation is not binding on the parties; rather it introduces into the settlement discussions an independent, third-party voice.  On the other hand, if parties agree to binding arbitration, they will be bound by the decision of the arbitrator.  Sometimes parties will agree to resolution of disputes by arbitration in their contract, thereby avoiding litigation.

Whether you are a plaintiff or defendant, hiring a qualified civil litigation attorney is crucial in achieving a successful outcome in your case.  The firm represents plaintiffs and defendants including individuals, partnerships, shareholders and corporations in various types of cases:

  • Breach of contract
  • Personal injury and negligence
  • Dissolution of business entities
  • Business disputes
  • Non-compete agreements
  • Bankruptcy litigation
  • Real estate litigation, including adverse possession and slander of title
  • Will contests and estate litigation
  • Debt collection, foreclosures and lien enforcement
  • Employment disputes
  • Breach of fiduciary duty

We believe our clients are best served by getting them from “Point A to Point B” as quickly as possible and with the least possible cost.  You don’t elect to have major surgery if a simple aspirin will get the job done.  Litigation can be expensive.  Accordingly, we evaluate your case for litigation alternatives, i.e., negotiation, mediation or arbitration, and seek the most appropriate and economical manner of handing the case.

When litigation is necessary, we engage and work closely with any experts necessary to present the facts to the court or a jury, including investigators, accountants, economic impact analysts, and other relevant professionals.  Our objective is a satisfied client, which is an attorney’s best advertising source.
